The DA in Portland has refused to prosecute anyone with Riot charges, because it would violate the first amendment rights of those rioters or people rounded up during the period a riot was taking place. This in light of the clashes with police and the perception of the police using force unjustly.

“His prosecutors won’t pursue demonstrators accused of interfering with police, disorderly conduct, criminal trespass, escape or harassment if the allegations don’t involve “deliberate’’ property damage, theft or force against another person or threats of force, Schmidt said.”
“The office also won’t prosecute people on a riot accusation alone. Prosecutors will proceed with a riot case only if it includes an accompanying allegation of specific property damage or use of force, he said.” “What we’re doing is recognizing that the right to speak and have your voice heard is extremely important,” Schmidt said. “If you’re out there committing violence, you’re damaging property, those cases are going to be prosecuted. If you’re a person who is out there demonstrating and you get caught up in the melee, those are the kinds of cases that we’re talking about.”

This correspondence occurred between the DA and Joey Gibson’s lawyer being he was charged for rioting and he claims innocence as he was trying to diffuse a situation:

“Gibson disputes the single charge of felony riot, his lawyers said. In court papers filed last year, a Portland police detective said Gibson could be seen in a video “taunting” and threatening members of antifa and later “physically pushing” a woman before she was hit with a baton and knocked unconscious by someone else.
Gibson’s lawyers contend the allegations that Gibson pushed the woman are “completely false” and said he was trying to defuse a fight between the woman and another man.”
Leading to this correspondence of the Layer and the DA office, where it is explained the policy to drop charges against Riot charges is not retroactively applied and set for specific dates:
Lee wrote to the deputy district attorney, requesting that the riot charge against Gibson be dropped, arguing Gibson hadn’t engaged in any other alleged assault or property damage.
“We therefore call upon your office to provide equal application of the MCDA policy and dismiss the charge against Mr. Gibson just as you would for any other individual charged only with riot,” Lee wrote.
Deputy District Attorney Brad Kalbaugh, after consulting with Schmidt, responded in an email to Gibson’s lawyers, informing them that the charge wouldn’t be dismissed. “My office’s new policy pertaining to riot trials is not retroactive,” Kalbaugh wrote.
Gibson’s lawyers pushed back, noting that nothing in the written policy that Schmidt’s office released said anything about “retroactivity,” yet it does say the policy will apply to “all referred cases arising from the current protests.”
So the DA will selectively and per case apply this standard to cases or “Rioting” charges and even states that in this quote:
“So, just so I understand,” Lee wrote back by email, “it does apply to cases from the protests that began around the end of May of 2020 through current, but does not apply back further to Mr. Gibson’s case?”

Joey Gibson’s case stems from an incident on May 1 2019 and the policy is pertaining to the events unfolding from late May of 2020. I like many see the political bend of the policies and one-sided treatment as the press and officials refer to leftwing rooted events even when property damage and person(s) assaulted or killed as “protesters” or mostly peaceful. While rightwing rooted events are seen as “counter-protester” “agitators” or “militia” and this framing device they deploy to separate them. That gives credence to the political bias lawsuit. But as I read, Joey Gibson’s charges are from May 1st, 2019 and the protection being given to rioters is only covering from May 2020. The merits are not there but one still could argue from a logistical standpoint the one-sided treatment in the press, the officials elected and public perception that Joey Gibson is at an uphill battle while other people(s) politically aligned have lighter handling being delivered to them.

As in the article “Portland mayor defends handling of violent protest” the police only arrested the protestors that attacked police not the reporter Andy Ngo who was attacked with eggs and milkshake said to be mixed with quickrete, as reported by the officers and social media posting but never confirmed. The left-wing affiliated protestors were nearly given free passes to assault opposing protestors or perceived opposition and while never facing a consequence. Now the arrest of Antifa during 2019 in Portland are sparse as the Communist movement is infamous for not co-operating but Antonio Scott Zamora who wore a unique mask was identified and charged. As of yet I can’t find new information on the charges and status of the case.

So, it is a new phenomenon in that only recently have they given carte blanche to Antifa and BLM, also the Black Block method Antifa uses makes it hard to target the wrong doer as they use the same tactics terrorist in the Middle East use. In that the US Soldiers can only engage enemies, as the terrorist dress like civilians a confirmed sight of firearm must be confirmed. So, they will walk around a corner pick up a weapon and fire at the US forces, to than drop the weapon disappearing into the crowd. Then the other participants will walk past the gun and repeat said action and the restriction of firing on non-military or combatants in play, our troops are in a bind. They can’t openly fire on the civilians but they are also being fired upon by the militants hiding in the civilian population. Hence like the Black Block method of Antifa where they hide in the crowd and they are all similarly dressed. To isolate the one who is doing the wrong doing is difficult and near impossible. That is why the previously mentioned person who was arrested was identified as his mask he used to hide his identity was unique to the other masks.

As Steven Mnuchin testified today and the issue of state funding came up, I am opposed to it wholly as they were struggling before the pandemic and now the state want federal dollars to be allocated to fix their short falls in policy and governing. Deguised as coronavirus relief. Let’s not pay attention to the shrinking tax base.

The post office needs reforming, the thing that’s causing the post office to run in the red is the fact they are partial government-subsidized and half private. And if they were a private company, they would be bankrupt and shut down. The packages they pay to their employees and the main reason I loathe public sector unions, is, for this reason, the retirement packages they provide are the main debt driver on top of their loss of profit for large packages.

Leading causes for state deficit is the pensions to the public unions.

Public sector unions demand X, state and local reps want reelection, promise X. Then when the next official is in, and that bill comes due, it’s their fault for not funding the retirement packages promised decades ago. To find those, they increase local state taxes to fund that. Hence the exodus from NY, CA, and many more. Unlike a private-sector union, where if the union demands cause the good of the company to increase, then leading to the company failing, in short, means the company and union must strike a balance. Or both fail and rightly so.

A consequence of the public sector unions is increased taxation for the current official to uphold a promise a former official made knowing that they would not be there to face the music when the bill is due. Now couple that with a shrinking tax base that was occurring before the pandemic. Exacerbated by the increased shrinking tax base as more leave due to unconstitutional edicts and BLM and Antifa riots and looting.

“His analysis shows the state was already in trouble after pushing off a $1.7 billion Medicaid bill in March 2019 into 2020, which grew into the $4 billion.” NY has had economic issues before the pandemic and deserves no bailout.

To be fair, Cuomo did okay, but the trap was laid decades ago, and the new climate of providing to undocumented and much more have complicated the situation.

When factoring in the cost of non-pension benefits for state workers, such as health care for retired government employees, the debt facing California taxpayers rises further.

“Combining California’s debt with publicly held federal debt, we estimate a total debt-to-GDP ratio of 125% (or 153% using the broader definition of federal debt),” California Policy Center report released in 2017 points out. “This level places California distressingly close to peripheral Eurozone countries that faced financial crises in 2011 and 2012. Portugal’s 2015 debt-to-GDP ratio was 129% and Italy’s was 133%.”

Also, they extended insurance via local state to illegals/undocumented on taxpayers’ backs to add to the Unions burden the taxpayers are covering.

The budget issue is a complicated ball of knots. So if one of those knots we’re to say be banned, collective bargaining amongst teachers, police officers and all the civil servants and they were just employees. Wealth tax is double taxation.

Net worth isn’t income. Net wealth is how much you are with assets and income. Taxing income I am not opposed to, but taxing net worth is not only counterproductive. Taxing net wealth is double taxation. Double taxing and taxation that occurs on the same income source after you already paid taxes on.

So you get taxed and collect via net pay, after paying taxes on the gross pay. Then you invest it and, in this context, are the head of a major company. Elizabeth Warren and Bernie Sanders held a similar policy before she and he dropped out.

As it was in their plans during the campaign. Households would pay an annual 2% tax on every dollar of net worth above $50 million, and a 6% tax on every dollar of net worth above $1 billion.

Let’s play this out, the Wealth-tax of Jeff Bezos’s net worth is estimated 130 billion dollars. His yearly income was $81,840, not his total worth of 130 billion is mostly stock. For many, that’s like so what, but after researching, that’s none liquidated income or assets. So, if he were to sell off to pay that tax, that would hurt Amazon stock prices, lowering the value of Amazon and decreasing the estimated net worth. That would be a side effect of what’s called a sell-off. More stock of a said company increases the supply but not, particularly the demand lowering the cost of the stock cost per share.

The stock market will influence the confidence of traders, companies, and consumers. That could cause a contraction and possible recession effect if not a recession.

The expansion of taxing to include wealth, not just income, will hinder the market as that heavy taxation could cause sell-offs and directly affect the USD and the stock market.

In the context of the pandemic currently plaguing the world, the material conditions have not changed but increased the reliance on the services, i.e. Amazon (Jeff Bezos) increased his net worth while not implicitly increasing the income taken in.

Say a retail worker earns, for instance, purposes 600$ every two weeks. Slowly they acquire assets and hopefully not incurring needless debt. Will increase the net worth but not their income. Or a student in which a loan via private or Sallie Mae and the debt is more than income earned. 600×2=1200 a month and outgoing bills monthly are 1300$, causing a negative net worth. But the acquisition of a house, participation in an EESP program, and other investment also increase or decrease net worth. That’s why the wealth tax is unfair and untenable, as I explained above. His investments, physical assets determine the net wealth of Jeff Bezos. Using money or income previously already taxed, he used his income to build up the wealth causing again a situation where one is taxed twice on the same source of income.

Ignoring the difference of income and wealth. If I hit the lottery as a minimum wage worker for 200 million. One lump sum and relocation later maybe worth 100 million. I maintain my job and the pay brings in as of right now for me 32k a year. My income is 32k a year but net worth is 100 million. So like Bernie, Warren would tax me based on money already taxed. One works gets taxed, banks it. The money in the bank is taxed and only interest earned is only taxable. Also, assets like Stock, Property and other items up to debt influence debt. As reported by NerdWallet “For example, if somebody has $500,000 of assets and $300,000 of debt, that person’s wealth or net worth than $200,000 and a 2% wealth tax would generate a $4,000 tax bill.”

So, Warrens plan is the same as Bernie’s and now some aspects of Bidens plans as some would wish it to be. Where its taxes wealth not income. That is double taxing and is usually an incident that occurs on the same source of income but channeled through more than one country.

I have been digging and digging found some more context, they threw a Molotov cocktail at Kyle, and he was responding to the discharge of a handgun, which leads him to be lunged at in the car dealership. He was there originally but left it, and the police wouldn’t let him back until later.

So he was there to protect buildings; he responded to a gunshot in the car dealership that caused him to shot a man in the head.

Mr. Rittenhouse’s gunfire is mixed in with the sound of at least 16 other gunshots that ring out during this time.”

As reported by CBS Chicago, the one person interviewed who was there protecting buildings was informed that the police would send the crowd towards them as they can take care of themselves.

Now the fact the police would send the protestors their way as they can or look like they can send for themselves is malpractice and just wrong; police are there to keep the peace, not send two opposing groups to collide with another. Even is the only confrontation is the destruction of private businesses.

As more information came out and the NYT reporting, Kyle was responding to a thrown Molotov cocktail, discharge of a handgun and a man lunging at him saying this:

In the end, he took lives; he needs to be held to the account. He did act in self-defense, didn’t cross state lines with a gun, not protected by the hunting provision, BLM/Antifa we’re smashing and destroying private property. This could have been avoided but killing someone’s small business is an assault on their person. The Jacob Blake case is not black and white shut the door case.

Jacob Blake is the recent victim of a police shooting in which they were reacting to him, ignoring commands and heading to his car. Look up, cops shot by and watch the videos of the people shooting the cops after going to their vehicle and retrieving their weapon. Now in the context of suspects retrieving their weapons and using them on officers think of this:

“In the footage, Blake walks from the sidewalk around the front of his SUV to his driver-side door as officers follow him with their guns pointed and shout at him. As Blake opens the door and leans into the SUV, an officer grabs his shirt from behind and opens fire while Blake has his back turned.”

That isn’t and should never be a justification, but to say that isn’t the reality of the cops well is ignoring the reality cops find themselves in. Also, the FaceBook image he has on his private personal page isn’t and shouldn’t hold any bearing on the case or facts.

Now, this isn’t a simple case of Jacob Blake smoked a blunt 15 years ago. As the official report, as indicated on FaceBook:

At 5:11pm Kenosha Police Officers were sent to the 2800 block of 40th Street for a domestic incident and were involved in an officer involved shooting.

Officers provided immediate aid to the person. The person was transported via Flight for Life to Froedtert Hospital, Milwaukee. The person is in serious condition.

Kenosha Sheriff’s Department and Wisconsin State Patrol were requested immediately so that the scene could be turned over to an agency, other than Kenosha Police.

The Wisconsin Department of Justice (D.O.J.), Division of Criminal Investigation (D.C.I.) will be investigating this officer involved shooting. Further media releases will come directly from D.C.I. Inquiries should be directed to dojcommunications@doj.state.wi.us

They were responding to a domestic incident, and yes, Jacob did break up the fight between two women, so it was a domestic dispute. Unknown what was known and when it was known but say they ran his license plate and it came up he has a warrant out for his arrest, or was that information gathered after the fact and has no bearing on the course of events that transpired. Or how they mention he has pulled a gun in 2015 in a bar, which does not mean anything substantial but character building showing a history of his actions. Also, each case should not be broadly viewed as the bar situation is vastly different than the event that unfolded that caused him harm.

They deployed a taser, and it failed to stop Jacob, and that’s why it escalated, but type your first and last name in Google, or FaceBook and see how many similar to your appearance and age. Now think about the fact a man fitting his description, and without further information, one must assume they went on appearance being black and similar age group. Complicated with the fact the warrant is for a Jacob Blake who matches the description of the one who got shot, similar age group and his non-compliance:

“A 2015 story in Racine Eye described how “Racine police say K9 Dozer had to help officers take a man into custody when the man refused to go quietly into custody after he pulled a gun at a local bar.” The man was described as Jacob Blake, 24, of Racine, which makes him the same age as the man shot by police on August 23. The Racine Eye story said he was charged with “one felony count of resisting arrest causing a soft tissue injury to a police officer and one misdemeanor count each of carrying a concealed weapon, carrying a firearm while intoxicated, endangering safety-use of a dangerous weapon, and disorderly conduct.” Those charges don’t show up on the circuit court website though.”

“Blake and two women were at the Brass Monkey tavern, 1436 Junction Avenue, Saturday when Blake got into an argument with another patron and pulled a black handgun. Blake pointed the gun at the other man, and the magazine fell to the floor. The bartender told Blake to leave, and he did but then pointed the gun through the window at patrons inside the bar before walking south on Junction Avenue.”

All sources indicate he was breaking up a fight and refused to obey orders while the deployment of the taser failed to incapacitate the victim. With recent reporting that Jacob is paralyzed as reported ny NYPost:

“Jacob Blake, the 29-year old black Wisconsin man shot in the back by a white cop, is paralyzed from the waist down – and doctors don’t know if his injury is permanent, his father said in a new report”

But the rage felt by the community led to an officer being knocked out with a brick, stores looted and cars destroyed. Jacob Blake’s cousin asking for the people to keep the city quiet, as he is pulling through, was undeaded as one can easily find out. Now I like many want the body camera footage and to know if they were acting in the heat of the moment or were the cops acting on Jacob’s matching the description and having the same name (again google your name see how many you share it with) causing the elevated response

I hope he pulls through and survives and proves his innocence with the revealed history of a person who share his name and description. I also hope the rioting and looting stops, and he gets a just reward for the damage done to him.

Later reporting shows that the cops were called on Jacob Blakely as he was trespassing and refused to return the keys to the girlfriend who he took the keys from as reported by MEAWW website:

“KENOSHA, WISCONSIN: Dispatch audio has revealed that Jacob Blake was shot immediately after the police officers arrived at the scene. The Black man was shot several times on Sunday, August 23, as he tried to enter a vehicle. The Kenosha police who reportedly responded to the 2800 block of 40th Street after receiving a complaint of “family trouble” shot Blake in the back numerous times less than three minutes after their arrival. The Journal Sentinel, a part of USA TODAY Network, has reported that the police radio traffic is from Broadcastify – the world’s largest source of public safety, aircraft, rail, and marine radio live audio streams. The outlet has also taken information from police radio transmissions, Kenosha police, video, and witnesses.

According to the timeline of the report, at around 5 pm on Sunday, a neighbor saw Blake barbecuing outside his apartment. By 5:11 pm, cops were sent to the 29-year-old’s address over a complaint of “family trouble”. A dispatcher told officers that a woman said Blake “isn’t supposed to be there and he took the complainant’s keys and is refusing to give them back”. The dispatcher also informed officers that an alert has been issued for a person there due to some reason, known in police radio code as a 10-99, at that address. It has been reported that an arrest warrant was issued for Blake stemming from a domestic case in May.

At 5:13:47 in the evening, one of the officers asked the dispatcher how Blake looks, they were told that the complainant had told the that Blake was trying to leave. And when the dispatcher tried to get Blake’s vehicle description, she reportedly became uncooperative, leaving cops with no information on the vehicle. The officer then told the dispatcher that he had arrived at the scene.

By 5:14:28 pm, another officer also arrived there and at 5:15:37 pm, a third officer asked the dispatcher to send three more squads. Around that time, a witness filmed a video that showed Blake and two cops tussling on the ground on the passenger side of a small gray SUV. The brawl happened less than two minutes after the first cop arrived.

While a different video taken by another person showed three officers – two males and one female – with their guns in their hands and behind Blake as he walked from the sidewalk around the front of the car.
